Welcome to Unified Judicial Services ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our process serving, litigation support, and related legal services, as well as our website at unifiedjudicial.com. By engaging our services or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Acceptance of Terms
By submitting a service request, creating an account, or otherwise engaging Unified Judicial Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you ("Client") and Unified Judicial Services. We reserve the right to refuse service to anyone at our sole discretion.
2. Services
Unified Judicial Services provides professional process serving and litigation support services, including but not limited to:
- Service of process (summons, complaints, subpoenas, motions, orders to show cause, and other legal documents)
- Court filing and document retrieval
- Skip tracing and address verification
- Mobile notary services
- Eviction and landlord-tenant services
- Stakeout and surveillance services
- Same-day, rush, and routine service options
- Nationwide and international service of process
Service timelines are estimates and may vary depending on circumstances beyond our control, including but not limited to respondent availability, weather conditions, court schedules, and jurisdictional requirements.
3. Service Requests and Authorization
By submitting a service request through our website, phone, or email, you authorize Unified Judicial Services to begin service of process or other requested legal support services on your behalf. You represent and warrant that you have the authority to authorize such service and that all information provided is accurate and complete.
4. Pricing and Payment
Service fees are based on the type of service, priority level, and location. Standard pricing is available on our website and may be updated at any time. Custom quotes may be provided for complex or high-volume requests. Payment is due upon completion of service unless other arrangements have been made in advance. Invoices not paid within 30 days of issuance may be subject to late fees of 1.5% per month on the outstanding balance.
5. Rush and Same-Day Services
Rush and same-day service fees are non-refundable once a process server has been dispatched. We make every reasonable effort to complete rush and same-day requests within the requested timeframe, but completion times are not guaranteed due to factors outside our control (e.g., subject availability, access to premises, weather conditions).
6. Service Attempts and Due Diligence
Standard service includes up to three (3) attempts at different times and days to effect personal service. If service cannot be completed after diligent efforts, we will provide a detailed affidavit of non-service documenting all attempts made. Fees for attempted service are non-refundable as they cover the time and effort of our process servers.
7. Affidavits of Service
Upon completion of service, we provide a sworn affidavit of service (proof of service) detailing the manner, date, time, and location of service. Affidavits are delivered electronically by default. Notarized originals and physical delivery are available upon request for an additional fee.
8. Client Responsibilities
Clients are responsible for providing accurate and complete information regarding the subject to be served, including correct names, addresses, physical descriptions, and any known scheduling information. Incomplete or inaccurate information may result in delays or inability to complete service. Unified Judicial Services is not liable for failed service due to incorrect information provided by the client.
9. Communications
By providing your contact information, you consent to receive communications from Unified Judicial Services related to your service requests via phone, email, and text message. Message and data rates may apply. For details on how your data is handled, please review our Privacy Policy.
10. Limitation of Liability
Unified Judicial Services' liability for any claim arising from our services shall not exceed the total fees paid for the specific service request in question. We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to missed court deadlines, case dismissals, or adverse legal outcomes resulting from delays or inability to complete service.
11. Cancellations and Refunds
Standard service requests may be cancelled for a full refund if no service attempts have been made. Once a process server has been dispatched, rush and same-day fees are non-refundable. Partial refunds may be issued at our discretion for standard service requests cancelled after the first attempt. Refund requests must be submitted in writing within 30 days of the service date.
12. Confidentiality
We treat all client information and case details as confidential. Information is shared only with assigned process servers and authorized personnel as necessary to complete the requested service. We do not sell, rent, or disclose client information to third parties except as required by law or as described in our Privacy Policy.
13. Indemnification
You agree to indemnify, defend, and hold harmless Unified Judicial Services, its officers, directors, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, any inaccurate information you provided, your violation of any applicable law, or any claim by a third party resulting from documents served on your behalf.
14. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of New York. Any disputes arising from these terms or our services shall be resolved in the state or federal courts located in Kings County (Brooklyn), New York.
15. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
